As they say... it will all end in tears! Separation and divorce is an unpleasant business, and there are many avenues and paths which we would recommend to get advice before planning a divorce or separation in Brisbane. There are local meet up groups where you can go for advice and support.
Separation
In Australia there is a law which recognises defacto relationships and could mean that you are in a financial agreement with someone you are living with. In the event of a breakdown, often the richer partner must pay to support the poorer one in the event of a partnership breakdown if they wish to peruse an end of relationship settlement. This is a dangerous situation, and does not give people the chance or opportunity to really get to know each other prior to getting married without any financial risk. This may also encourage people to remain single. Ask yourself, who do you trust? How long does it take to really know someone? Are you a good judge of character? Jesus himself was betrayed, and he was the son of god.
The current law could mean that if you live with someone for a year they may be able to take half your possessions. This is a dangerous situation if you have significantly more than your partner and there are many unscrupulous persons making a living out of getting into relationships with a wealthy partner. Why risk your assets, and your children’s inheritance? Protect your right to give money to who you wish. Do not enter into a precarious legal situation where you cannot afford to end a relationship. Imagine yourself in a relationship, which turns out to be abusive – but you cannot afford to separate since you have more assets than your partner.
The only way to (possibly) protect yourself is to have a cohabitation agreement drawn up by a lawyer. The agreement must be certified, and fully understood by both parties. In some cases where a couple’s situation changes drastically the agreement may not hold.
