Divorce settlement and custody is a complicated affair, especially where children are involved. Partners should consider themselves as jointly responsible for the births of their children and they should have equal responsibility for the children being raised until they are at least 18 years old. At least, this is the government’s reflection of what they consider the culture in Australia dictates.
Family Law Amendment (Shared Parental Responsibility) act in 2006 gave more rights to fathers to spend time with their children. Although they may not be able to get to spend half of their time with their children, in most cases these days their parental role should be considerably more than just alternate weekend visits from their children.
Child custody is a complicated affair, and women are still considered by many to be best suited to raising (particularly young) children. This is usually seen by judges as the woman’s more natural role and being more beneficial to the emotional wellbeing for a child to have a close relationship with their mother.
